With reference to H. M. Acting Consul General's memorandum of March 23rd respecting certain shares claimed by Mae, Guignard, I have the honour to inform you that the shares in question are on the Shanghai Register of the Hongkong and Shanghai Banking Corporation and that the Custodian of Enemy Property, Hongkong has no power to release them even if Mine, Guignard's claim for the release of the

shares me otherwise valid.

The Secretary of State for the Colonies under the

impression that the Hongkong and Shanghai Banking Corporation

shares on the Shanghai Register came under the jurisdiction of the Hongkong Custodian originally issued instructions to

that officer to realise the shares on both the Hongkong and

Shanghai registers. As a result of representations made by

the Bank these instructions so far as the shares on the

Shanghai register were stayed and the shares remain in suspense pending the decision of the Law Officers of the

Crown in London. As the question is likely to be of interest

to H.B.M.'s Law Officers in China, I enclose a copy of a

letter from the legal advisers of the Bank showing the

attitude the Bank has had to take up to safeguard its

interests in the event of possible proceedings being taken

through the Court at Shanghai.

Apart from the question of jurisdiction of the shares, Mine. Guignard's claim is open to several objections. The lady is by marriage a German subject and cannot regain French nationality unless she returns to France and resides there. The children remain German subjects in any case until
